Terms and Conditions

Introduction

These are the Terms and Conditions ("Terms", "Terms and Conditions") that govern your use of the RefundU mobile application (the "Application", "App") and its related services. These Terms apply to all users of the Application.

By accessing or using the Application, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Application.

Definitions

For the purposes of these Terms and Conditions:

  • "Company" (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to RefundU.
  • "Device" means any device that can access the Application such as a smartphone or tablet.
  • "Service" refers to the Application and all related services.
  • "You" means the individual accessing or using the Application, or the company, or other legal entity on behalf of which such individual is accessing or using the Application.

Eligibility

You must be at least 18 years of age to use this Application. By using the Application, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

Account Registration

To use certain features of the Application, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account password
  • Accept all responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete.

User Obligations

You agree to:

  • Use the Application only for lawful purposes
  • Not impersonate any person or entity
  • Not interfere with or disrupt the Application or servers
  • Not attempt to gain unauthorized access to any portion of the Application
  • Provide accurate personal information including ID number, phone number, and email address
  • View advertisements in good faith
  • Not attempt to manipulate or abuse the token reward system

Tokens and Rewards

  • Tokens are earned by viewing advertisements and engaging with promotional content
  • 3 tokens can be redeemed for a R50 voucher from participating retailers
  • Tokens have no cash value and cannot be transferred, sold, or exchanged
  • Tokens may expire if account is inactive for an extended period
  • We reserve the right to modify the token earning and redemption system with notice
  • Fraudulent activity may result in forfeiture of tokens and account termination

Vouchers

  • Vouchers are digital and stored in your Application wallet
  • Vouchers must be redeemed at participating retailers only
  • Vouchers have expiration dates which will be clearly displayed
  • Vouchers cannot be exchanged for cash
  • We are not responsible for products or services provided by retailers
  • Lost or stolen vouchers cannot be replaced

Referral Program

  • Users can earn tokens by referring new users to the Application
  • Referral rewards are subject to verification
  • Fraudulent referrals will result in forfeiture of rewards and potential account termination
  • We reserve the right to modify referral rewards at any time

Advertising and Marketing

By using the Application, you consent to:

  • View advertisements from third-party companies
  • Be contacted by advertisers whose content you have viewed
  • Receive marketing communications related to products you have expressed interest in
  • The collection and sharing of your information with advertisers as outlined in our Privacy Policy

You may opt out of certain communications through your account settings.

Intellectual Property

The Application and its original content, features, and functionality are owned by RefundU and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

  • Reproduce, modify, or create derivative works of the Application
  • Reverse engineer or attempt to extract source code
  • Use the Application's content for commercial purposes without permission

Privacy and Data Protection

Your use of the Application is also governed by our Privacy Policy. By using the Application, you consent to the collection and use of information as outlined in our Privacy Policy, including compliance with the Protection of Personal Information Act (POPIA).

We retain your personal information in accordance with South African legal requirements:

  • Personal and transaction data: Retained according to specific timeframes outlined in our Privacy Policy
  • Financial compliance records: Retained for 7 years as required by the Tax Administration Act and Companies Act
  • Marketing and profile data: Retained for 3 years after account closure
  • Legal and dispute records: Retained as required for compliance and protection of rights

Detailed retention periods for all data categories are available in the "DATA RETENTION" section of our Privacy Policy. These periods balance our legal obligations with POPIA's data minimization principle.

Third-Party Services

The Application may contain links to third-party websites or services that are not owned or controlled by RefundU. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Disclaimer of Warranties

The Application is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, including but not limited to:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free service

Limitation of Liability

To the maximum extent permitted by law, RefundU shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or other intangible losses resulting from:

  • Your use or inability to use the Application
  • Unauthorized access to your account or personal information
  • Any conduct or content of third parties on the Application
  • Any content obtained from the Application

Indemnification

You agree to indemnify and hold harmless RefundU, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Application
  • Your violation of these Terms
  • Your violation of any rights of another user or third party

Account Suspension and Termination

We reserve the right to suspend or terminate your account and access to the Application at our sole discretion, without notice, for conduct that we believe:

  • Violates these Terms
  • Is harmful to other users, third parties, or our business interests
  • Is fraudulent or abusive

Upon termination, your right to use the Application will immediately cease, and any accumulated tokens may be forfeited.

Inactive Accounts

To ensure compliance with data protection principles and maintain an active user base:

  • Accounts with no login activity for 24 consecutive months are considered inactive
  • At 18 months of inactivity, we will send a warning email to your registered email address
  • At 22 months of inactivity, we will send a final notice informing you of impending deletion
  • At 24 months of inactivity, your account will be automatically deleted following the same deletion process outlined below
  • You can prevent automatic deletion at any time by logging into your account
  • All unredeemed tokens and active vouchers will be forfeited upon automatic deletion

This policy helps us comply with POPIA's data minimization principle while protecting user accounts from unauthorized access.

Account Deletion

You have the right to delete your account at any time. There are two ways to request account deletion:

  1. Using the "Delete Account" button in the Profile section of the Application
  2. Sending an email request to info@refundu.co.za

When you delete your account:

  • Most of your personal information will be permanently deleted within 30 days in accordance with our Privacy Policy and POPIA
  • Some information will be retained in anonymized form as required by law:
    • Transaction records: Retained for 7 years for tax compliance (Tax Administration Act)
    • Financial records: Retained for 7 years for audit purposes (Companies Act)
    • Fraud prevention records: Retained for 5 years to protect the platform
    • Legal dispute records: Retained until resolution + 2 years
  • Any unredeemed tokens will be immediately forfeited and cannot be recovered
  • Any active vouchers in your wallet will be cancelled and become invalid
  • Your referral code will be deactivated
  • IMPORTANT: Anyone you referred to RefundU will lose the referral token that was awarded for their registration. This means:
    • If you referred users who contributed to earning you tokens, those referred users will have their referral-related tokens removed
    • This action is irreversible and cannot be undone
    • We recommend informing anyone you referred before deleting your account
  • Backup systems containing your data will be purged within 90 days
  • This action is permanent and irreversible - you cannot recover your account, tokens, vouchers, or referral history after deletion

Data Retention After Deletion

The following data retention periods apply after account deletion:

  • Identifiable personal data (name, email, phone): Deleted within 30 days
  • Transaction history: Anonymized and retained for 7 years (legal requirement)
  • Consent records: Retained for 5 years as proof of rights exercise
  • Support correspondence: Retained for 5 years for dispute resolution
  • Security logs: Retained for 2 years for fraud prevention

Before deleting your account, we strongly recommend:

  • Redeeming any tokens you have accumulated
  • Using any active vouchers in your wallet
  • Requesting a data export if you wish to keep your information (email info@refundu.co.za)
  • Understanding that users you referred will be affected
  • Noting that some anonymized data will be retained for legal compliance

Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by:

  • Posting the new Terms on the Application
  • Sending notification through the Application or via email

Your continued use of the Application after such modifications constitutes your acceptance of the updated Terms.

Modifications to Service

We reserve the right to modify or discontinue the Application or any features temporarily or permanently, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Application.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or your use of the Application shall first be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RefundU regarding the use of the Application and supersede all prior agreements and understandings.
